Terms of Service – Screen Advertising Placements

These Terms of Service ("Terms") govern the access to and use of the screen advertising services provided by TBH Growth x Smacks Hamburgers (“we,” “our,” or “the Provider”) across select retail stores in the United Kingdom and Dubai.

By submitting an application or making a payment, you (“Client” or “you”) agree to these Terms.

1. Eligibility & Application Requirements

To begin using our advertising services, all Clients must:

a. Complete the Online Application Form

All fields must be accurately completed.

Any false or misleading information will result in immediate disqualification without refund.

b. Submit the Following Documentation:

For Individuals (e.g., artists, influencers):

Valid government-issued ID (passport, driver’s license, national ID card)

A clear photo/selfie for identity confirmation

Proof of address (within the last 3 months — utility bill, bank statement)

For Companies/Brands:

Certificate of Incorporation or Company Registration

VAT number (if applicable)

Business license (if applicable)

Government-issued ID of a company director or authorized signatory

Proof of business address

Signed declaration form authorizing the ad campaign

c. ID Verification Process

All ID documents will be reviewed using a verification system or manually by our compliance team. Failure to pass verification will result in cancellation of the campaign and a refund minus a 10% admin fee.

2. Content Submission & Format

All advertising creatives must adhere to our format and be submitted at least 5 business days before the campaign start date.

a. Accepted Formats:

Videos: MP4, 1080p minimum, maximum 60 seconds

Images: JPG/PNG, high resolution (1920x1080 minimum)

b. Submission Channels:

All files must be uploaded to the secure link provided after application approval.

c. Approval Timeline:

Review takes 2–3 business days.

Final assets must be approved before any campaign begins.

Late submissions may delay campaign start.

3. Content Restrictions – Prohibited Material

The following strictly prohibited content will be rejected without exception:

Sexual or explicit content (nudity, adult themes, suggestive material)Hate speech, discriminatory or inflammatory contentViolence, weapon-related or graphic imageryPromotion of illegal drugs, substances, or paraphernaliaPolitical or religious messaging (unless pre-approved)Scams or misleading advertisementsDefamatory or false claimsGambling-related content (subject to local law restrictions)Any content that violates UK ASA, Dubai Municipality, or Federal UAE advertising regulations Any breach will result in immediate removal and no refund will be issued.

4. Payment Terms

a. Full Payment Required in Advance

Your campaign will only be confirmed once payment is made in full. Payment secures your screen slot and time.

b. Pricing Overview:

30-second screen slot: Starting from £500

60-second slot: Pricing available on request

Custom package pricing depends on location, frequency, and duration

c. Payment Methods:

Debit/Credit card

Online payment gateways (Stripe, PayPal if applicable)

d. Currencies Accepted:

GBP (£)

AED (د.إ)

e. Invoices & Receipts:

A VAT invoice will be issued upon request for all payments.

5. Campaign Duration, Scheduling & Extensions

a. Standard Campaign Duration

Each campaign runs for a minimum of 7 days unless otherwise agreed.

Slots will be looped on rotation throughout operating hours of each store.

b. Schedule Confirmation

You will receive a confirmation email with store locations, campaign dates, and play frequency.

c. Extension Policy

Extensions must be requested at least 7 days prior to the end of the current campaign.

Additional fees apply for all extensions and will be subject to slot availability.

6. Cancellations & Refunds

a. Client-Initiated Cancellation:

No Refunds

b. Provider-Initiated Cancellation:

We reserve the right to cancel or reschedule campaigns due to technical issues, compliance reasons, or force majeure. In such cases, the Client will be offered:

An alternative start date, or

A full refund

7. Verification & Screening:

TBH Growth x Smacks Hamburgers reserves the right to request additional documentation or conduct further background checks to ensure compliance with all applicable laws and internal policies.

If at any time you are found to have submitted fraudulent, fake, or misleading documentation, your account will be blacklisted and no refund will be provided.

8. Legal Liability & Indemnity:

a. Client’s Responsibility:

You acknowledge that you are solely responsible for the content, legality, and accuracy of your ad.

b. Indemnification:

You agree to fully indemnify and hold harmless TBH Growth, Smacks Hamburgers, its partners, employees, and affiliates from any claim, liability, legal cost, or damage resulting from your content or campaign.

9. Ownership of Materials:

By submitting content, you confirm you own all rights or have full permission to display the material. We do not assume liability for copyright violations.

10. Service Availability Disclaimer:

Screen time is subject to availability and is allocated on a first-come, first-served basis. TBH Growth x Smacks reserves the right to adjust ad timings based on store operational hours and technical requirements.

11. Jurisdiction & Governing Law:

For campaigns in the UK, these terms are governed under UK law

For campaigns in Dubai, these terms are governed under UAE commercial and advertising law
